My husband is considered LLC. He gets a K1. Along with everyone else at his work (small shop, LLC is a means around a few things). No one's wife works. EVERYONE there got a stimulus check...except us and we keep being told by the IRS that we don't qualify due to LLC. We took it to the tax guy...same guy BIL uses (BIL works at the same shop). He said it's because we are LLC. However, BIL is also. He doesn't know. We went to the IRS office. It's because we are LLC. So is everyone else there. She doesn't know...we would have to have the others bring their tax forms in to see why they are getting one. The boss talked to his CPA (all paperwork goes through him before anyone else gets it). He said we should get one also or no one should be getting one. Our tax guy, the boss, and possibly even the CPA have sent letters to the IRS inquiring. No one has heard back. Everyone else in the two businesses (the shop and the boss's brother's business that is related to the shop and run the same) ALL received their checks this week.

I've already settled it that we're not getting one. But it's just so darn messed up. And no, I highly doubt BIL would go into the IRS office to show his tax forms...even though he his forms would be the ones identical to hubby's...including number of children, etc. BIL is a jerk to say the least (if it weren't for the others getting a stimulus check, then I'd wonder if BIL didn't cheat on his tax forms...he's been caught cheating on other things)

okay, rant off. Any advice is more than welcomed.

Hmm, don't know . . . Are you filing a 1040 with a schedule K? And everyone has an equal share reported to them?

No: K1 and everyone earns differently. Everyone earns over $35,000.

And the IRS does NOT answer their phone...I want a HUMAN BEING! My need is not on the menus...I've even tried going down paths that have nothing to do with me.

key to getting a person on the phone...push 0 really fast 2-3times. (and no, it's not on the menu)

You filed a 1040 with an adjusted gross income above $0?

Yeah, I know the IRS doesn't answer the phone. I was on hold for 60 minutes before anyone picked up the phone last week. Then they placed me on hold for another 10+ minutes to look something up. It was unbelievable!

yes (I had to look)

Got one IRS guy that said yes we should have received one, but he doesn't work in that dept (I went through the business line this time...he's transferring me).

Did you try the tools at the irs website? Specifically the calculator and Where's my payment?

Also, could you have an AGI higher than the threshold or a tax liability lower than the threshold required?

The IRS lady on the phone went through it with me and said we don't qualify. BIL says he filed the same way with no other income. The boss the same. And naturally no one wants to go down to the IRS office because they are afraid of having to pay the gov back. It really, really stinks. Bright side, if anyone gets audited, it won't be us having to owe the gov.
