View Full Version : Say you take time to return your shopping cart to the cart return space

that only has those little bump things and you place it in there because if you leave the cart in the parking space next to your car it might bump a car and the wind that's blowing causes the cart to roll over the little bump things and into a parked car are you responsible for the bump or is the store?

neither....parking lots are a "park at your own risk"...at least that is the legal answer...LOL

I never looked into it, but I agree with this. Having a recent dent next to the keyhole in the door, I know there is nothing I can do about it so I didn't even try. That's what I get for always making sure I am never responsible for a run away cart. Oh well.

Really? Do you mean if you bump a car next to yours with your car door....it is no one's fault? I hit a car in a parking lot once.....and sure enough....it was MY fault and my insurance had to pay. So....I can't agree with it is no one's fault. I think the store would be at fault...since you did the responsible thing by returning the cart...the negligence comes from the store not having the proper containment.

No...when your car does damage to another car then you are responsible...but when a cart does damage, regardless of whether you returned it to the bay or not...UNLESS you deliberatly cause the damage, of course....is a no fault.

I think the run away cart is different than your own personal car. The cart belongs to the store, is in a public place and is for use by the public. Your car is owned by you and is only operated by you. In your car, it is your responsibility.

yes, I always return my cart as well...and have MANY dings from those that have not...and from those that just throw their door open into my car too....and my insurance agent was the one that told me about the whole "no fault" thing....bleh

yup - that be the case!

I went out to my van at a Walmart once and a little old lady was standing by my van almost in tears - she had nicked the corner with her car. Being an honest person, she ahd waited to tell the owner (me.) I just told her not to worry - the van had other dings etc. already. She HUGGED me. I had the kids with me and told them that the lady had done the right thing to wait. I think I made her day by not being an irate big ol' guy! ;)

That's why you should always park next to a car that's nicer than your own...they're not as likely to let their open door touch your car. ;)

Good theory up to a point. There are areas around here where people apparently have so much money they've stopped paying attention to who they run into. Dh's cousin pointed this out to us when we moved here -- she hates to drive in west county grocery store parking lots because of this. Sure enough, I've seen it happen -- people yakking away on their cell phones while driving their expensive-mobiles right into another parked car, because, hey, it's only money, and their phone call is more important than your door or fender. And even if the people pay for whatever damage they cause, it's annoying to have to spend the time to get the dings fixed.
