I can't imagine them suing the bat manufacturer.....even though they claim balls hit with metal bats come off the bat much faster. It would seem to me that a 'strong' player could do the same damage no matter what kind of bat it was.....but what do I know about bats, LOL!
I think parents should know the consequences of sports injuries/fatalities before enrolling their child. This just seemed like a freak accident to me.

I know of at least one case where the victim's insurance company forced a suit like this. It may be the case this time or it may be that the money to cover care is desperately needed.
It's a tragedy no matter how you look at it.

I'm not surprised when people sue over issues like this. The tragedy, frustration, heartbreak and anger meets our sue-happy society and marketing-to-the grieving. It's a tragic match.
From the article:His family plans to file a lawsuit Monday against the maker of the metal bat that was used in the game, against Little League Baseball and a sporting goods chain that sold the bat. The family contends metal baseball bats are inherently unsafe for youth games because the ball comes off them much faster than from wooden bats.
There has been a string of injuries the past two decades involving metal bats launching balls that have killed or maimed young players across the country. The Domalewskis' lawyer claims bat manufacturers put speed ahead of safety; one even advertised a bat so powerful it is capable of "beaning the third baseman" with a line drive.
Sports injuries happen. More happen with metal bats not because they are inherently more dangerous, but because more boys use them, especially as they move up the age ranks.
It's not "OK" that it happened. But it's no person's, no organization's, no company's fault.

T read this just this morning. So very sad. In my opinion which means very little I think deap inside they realize it was a freak acciedent but, with millions of medical biils they have a lawyer saying sue!! I don't know how I would feel in this situation and pray I will never be in it at all. I think they are scared that they will not be able to take care of their son. As a parent I could see that. I just don't know but I feel so bad for them. It really seems that with all the money in taxes etc and all the money going out of our country there would be some type of fund for those who have these freak accidents.

it may be the only way the family can cover medical expenses. Whether they don't have enough insurance or their primary insurance requires them to seek compensation. Taking care of a severely disabled persons is extremely expensive.
If he had died, there still may have been medical expenses to cover, but less. I know of a family whose child died in a tragic accident. The parents divorced over the issue and the father sued. The mother followed along with the lawsuit, but it forced her to relive everything. The father seemed to want revenge(maybe wrong word). Mom knew lawsuit wouldn't make her whole already. Dad hadn't moved through the steps of grief beyond anger.

How awful. A freak accident, to be sure, but maybe they need someone to "blame." As other posters pointed out, they may also need help with the medical bills.
Don't you have to sign some sort of release to play sports? Of course injuries happen during sports.
I can only imagine how horrible the parents feel.
My guess is that the businesses involved will try to settle out of court though. Such lawsuits are very expensive and bad for business.
DH is disabled with chronic pain, PTSD, and various other issues, and we've been encouraged to sue. We won't though because it's a very tiring, emotional thing and in all cases but one, the doctors frankly did their best. The one bad doctor has been sued multiple times and always wins, and we're not willing to pursue it right now. We're on our third appeal with Workman's Compensation right now, and that's been a horrible, horrible experience.
What a world!

it's tragic for the families, but the fact is that physical sports are dangerous. no one wants to see something like that happen, but every parent should realize that it's possible. life is about balancing risk vs benefit. the risk of something like that happening is very low when you think about how many kids across the country participate each year.

:iagree: Taking all emotion out of it and looking just at the situation. It is NOT the bat makers fault. Just like a gun doesn't shoot itself, a pencil doesn't fly across a room and hit an eye alone- Sadly it was a freak accident.
sidenote-- our little league doesn't allow wooden bats. they break, and splinter.

That is the way I feel also. Why should someone have to pay for a freak accident..... People are always looking for 'blame' these days.
